These Terms govern access to and use of Cala Hype (the "Service"), operated by Bojan Antonijevic. By using the Service you accept these Terms. If you do not agree with any of them, please do not use the platform.
1. Acceptance
Using the Service means you fully and unconditionally accept these Terms and our Privacy Policy. Bojan Antonijevic may amend these Terms at any time; the current version is always the one published on this page, and material changes will be communicated to registered organisers.
2. Description of the Service
Cala Hype is a platform that lets organisers publish events across Mallorca and lets visitors discover them via list, calendar, map and search. The Service does not promote or organise the events; it simply provides the technical infrastructure for publishing and browsing them.
3. Organiser accounts
Organisers can create an account through a magic-link email. They are responsible for keeping their access private and for every action taken from their account. Actually publishing events requires prior approval by the administration team.
4. Content published by organisers
Organisers are solely responsible for the content they publish (title, description, images, location, price, and other fields). By publishing, they confirm that they hold the necessary rights or have obtained the required permissions, and they grant Bojan Antonijevic a non-exclusive, worldwide, royalty-free licence to host, index and display that content on the Service for distribution purposes.
5. Prohibited use
It is forbidden to use the Service to publish unlawful, misleading, discriminatory, violent, defamatory content, content that infringes third-party rights, or content that is contrary to public morals or public order. Automated scraping beyond reasonable technical limits, reverse engineering of the Service, and any action that compromises its security are equally forbidden.
6. Intellectual property
The brand, logo, design and proprietary code of the Service belong to Bojan Antonijevic or its licensors. Content published by organisers remains their property, subject to the licence granted in the previous section. Any reproduction without permission is expressly forbidden.
7. Disclaimer
The Service is provided "as is" and "as available". Bojan Antonijevic does not guarantee the accuracy, completeness or timeliness of the information published by organisers. Ticketing, attendance and any economic relationship arising from an event are established directly between the visitor and the relevant organiser.
8. Limitation of liability
To the maximum extent permitted by law, Bojan Antonijevic shall not be liable for indirect damages, loss of profits or loss of opportunity arising from the use of, or inability to use, the Service. Nothing in these Terms limits liability for wilful misconduct, gross negligence, or damage to life or physical integrity.
9. Suspension and termination
Bojan Antonijevic may suspend or close accounts that breach these Terms or compromise the security of the Service, with prior notice unless the situation is urgent. Organisers may request account deletion at any time by emailing [email protected].
10. Governing law and jurisdiction
These Terms are governed by Spanish law. For any dispute arising from their interpretation or performance, the parties submit to the courts of the consumer's place of residence when the user acts as a consumer, and to the courts of Bendinat in any other case.
